Latin America has often been represented by images of pre-Columbian artifacts and artwork on book covers and in other printed materials produced by Latin American studies. This article tries to show that there are strong connections between this type of representation and the semantics of Latin America both in everyday English language and in the discourses of the social sciences. First, the author reviews the history of the concept of Latin America in everyday English language, showing how it has been (...) defined as the opposite of a glorified collective self-image of America, in cultural, temporal, and racial terms. Next, chief approaches of Latin American studies (modernization theory, studies of corporatism, and the present-day textbook literature) are examined, focusing on how social scientific discourses have defined Latin America. Before returning to the topic of pre-Columbian representation, the covers of the best-selling present-day textbooks are surveyed to show how these pictorial representations reproduce the cultural and temporal perceptions of otherness already present in the texts, plus a racial perception that is mostly absent in them. The author argues that the pre-Columbian representation reproduces the three aspects of Latin America’s othering in a powerful and synthetic way. Last, the results of the present analysis are evaluated in the light of some contributions to postcolonial theory, visual culture studies and picture theory. (shrink)

The article presents a new typology of forms of misrecognition. Through a critique of Axel Honneth's Hegelian-Republican treatment of the issue of recognition, I elaborate an alternative typology of misrecognition forms inspired by Reinhart Koselleck's notion of asymmetric counterconcepts. After deriving three basic forms of misrecognition from historical examples of counterconceptual pairs, I examine some properties of their linguistic articulation as well as the horizons of expectations associated with their usage. O presente artigo explora as manifestações básicas do conceito de justiça em Jr. 1-25, atendendo à interacção entre justiça social, realeza e profetismo no contexto do Próximo Oriente antigo. É contextualmente analisado o principal léxico pertencente aos campos semânticos da justiça e da injustiça, em sentido estrito, incluindo as categorias sociais directamente envolvidas (estrangeiro, viúva, órfão, pobre, oprimido, necessitado, etc.). Nos termos do iaveísmo hierosolimita e da ideologia régia davídica, Jeremias desenvolve um discurso de denúncia social relativamente genérico sobretudo direccionado (...) para a realeza, exortando-a a cumprir o seu papel de garante do funcionamento e implementação da justiça na sociedade. É contra Joaquim que a polémica jeremiana atinge o seu auge, criando uma imagem de anti-rei que inverte totalmente o paradigma de realeza humana e divina exemplarmente retratada nos salmos reais. O direito consuetudinário do Código da Aliança, e sobretudo a tradição profética (Amós, Miqueias e Isaías) e sapiencial (Salmos e Provérbios), e não o Deuteronómio, devem fornecer o quadro interpretativo preferencial para o conceito de justiça social em Jeremias. Arguing for the theoretical importance of the concept of “subject” or “self” on behalf of the “psychiatric/psycho-pathological thinking” is justified in so far as, as Costa, Bezerra Jr., and Gama say, “this is still an indispensable concept for understanding the conditions for the gestation and functioning of psychological life.” In what sense are these concepts “indispensable?”All the hints suggest them as necessary complements for neurobiological investigations to become useful for clinical employment. Heroism presumes “humanity.” Black candidates for heroism in the United States, however, must often overcompensate for the presumed sub-humanity imposed upon them by the American popular imaginary. By way of an illustration, consider the instructive case of the Rev. Dr. Martin Luther King Jr., who, arguably, attains the status of American Hero in spite of his Blackness. Through a unique account of the life of Dr. King, I will argue that King attains the requisite overcompensation necessary for American heroism by (...) becoming what João Costa Vargas and Joy James call a Baldwinian Cyborg, a “super human with unnatural capacities to suffer and love.” I will present, here, a literary narrative that weaves speculative fiction into the interstices of the historical record in order to contend that the Black Cyborg is necessary in a world where white Americans are “human” but Black citizens remain aspirations. The exchange of goods and services between individuals is often formalised by a contract in which the parties establish norms to define what is expected of each one. Norms use deontic statements of obligation, prohibition, and permission, which may be in conflict. The task of manually detecting norm conflicts can be time–consuming and error-prone since contracts can be vast and complex. To automate such tasks, we develop an approach to identify potential conflicts between norms. We show the effectiveness of our (...) approach and its individual components empirically using two publicly available corpora, and contribute with a new annotated test corpus for norm conflict identification. Banez’ commentary on I, q. 3, art. 3, is justly well-known for the criticism of earlier Thomists and for its metaphysical acuity. But Banez’ skill is best seen when we read not only his commentary, but the other texts which he himself was reading, such as the works of Capreolus, Soncinas, and Cajetan. In particular, he connects three issues which at first glance might seem unrelated, namely the view that esse is the ultimate act, that it is reduced to the (...) categories, and that it is less perfect than essence. The view that esse is the ultimate act implies that it can be reduced to the category of what is prior to it as the imperfect to the perfect. The position that essence on its own is prior and belongs to a category can lead to the view that essence is more perfect than esse. (shrink)

This text aims at pointing out some of the philosophy of law present in the works of the Hellenist philosopher and physician Sextus Empiricus (ΣΕΞΤΟϒ ΕΜΠΕΙΡΙΚΟϒ), and supports two main theses: the first, based on an epistemological point of view, presupposes that exact knowledge of the world — that is, an entirely adequate relationship between the mind of each human being and the events around — is not possible, which insurmountably renders all perception relative. The second thesis, from an axiological (...) point of view, postulates that Skepticism does not necessarily imply disregarding concepts of justice or abandoning any ethical parameters, but functions as an immunizing element against intolerance and dogmatism. The central argument of this article lies in the intent to think, from a reading of The Invention of Morel, about the subversion possibilities, simultaneously discursive and operational, of certain structures of capitalism, carried out by discrete elements of society, regardless of their social standing. Discussing Morel himself and his invention, I postulate the hypothesis that Morel is subversive because he is perverse. As a preamble to this discussion, and in an attempt to turn it into a critique of current (...) times, a reading of Slavoj Žižek’s 2009 article entitled “Censorship Today: Violence, or Ecology as a New Opium for the Masses” will be undertaken. Through a comparative analysis of the rational underlying the four antagonisms which, in Žižek’s opinion, will prevent the indefinite reproduction of the current “naturalization” of capitalism in the global world, and Morel and his invention, one concludes the latter’s obscene perversity causes, through exaggeration, potentially destructive effects of the very mechanisms and capitalist subsystems which generated them, thus deconstructing their significant codes. Nas últimas décadas, a intervenção sobre a vida na rua tem vindo a assumir um caráter crescentemente medicalizado, formatando-a como uma questão de anormalidade neuro-psiquiátrica individual. Com base na observação direta de diversos tipos de interações da vida na rua são discutidos vários exemplos da medicalização de condutas de sujeitos sem-abrigo. Estes deixam claro que medicalizar a vida na rua é um procedimento intrinsecamente “grotesco”, no sentido que Foucault confere ao termo, referindo-se a uma maximização dos efeitos de poder que (...) parte da desqualificação fundamental de quem o exerce e dos seus enunciados. OS DIREITOS HUMANOS COMO NORTEADORES DO DIREITO NO ÂMBITO DAS RELAÇÕES INTERNACIONAIS: A APLICABILIDADE DA TEORIA DE JUSTIÇA DE JOHN RAWLS NA ORGANIZAÇÃO DAS NAÇÕES UNIDAS.

This article explores the philosophies of Heidegger and Wittgenstein to illustrate the thesis that philosophy is a human activity exhibiting a unity of investigative and therapeutic aims. For both philosophers, the purpose of philosophical concepts is to point toward a path of transformation rather than to explain. For both, a first step on this path is the recognition of constraining illusions, whether conventional or metaphysical. For both, such illusions are sedimented in linguistic practices, and for both, philosophical investigation is a (...) way of emancipating thought and life from illusion by bringing what is already prereflectively understood into the light of thematic explicitness. And what both philosophers bring into thematic explicitness are aspects of the context-embeddedness and finitude of human existence. It is hoped that comparing the works of these two philosophers will unveil features of each that are more difficult to discern in the works of either considered in isolation. (shrink)

Even though it is obvious that mathematics involves social activities, this rather trivial fact is rarely considered as important for its subject matter, mostly due to its undesired ontological consequences. An attempted solution for this tension was developed by Julian Cole’s institutional account of mathematics, named Practice- Dependent Realism. In the present paper, Cole’s account is evaluated, and its lights and shadows assessed concerning the ontological problem that he seeks to solve. I argue that his institutional account, although failing in (...) delivering a sufficient ontological account of mathematics, still opens an important linguistic route for explaining its practice. Against its prominent compatiblist and libertarian opponents, I defend Galen Strawson's Basic Argument for the impossibility of moral responsibility. Against John Martin Fischer, I argue that the Basic Argument does not rely on the premise that an agent can be responsible for an action only if he is responsible for every factor contributing to that action. Against Alfred Mele and Randolph Clarke, I argue that it is absurd to believe that an agent can be responsible for an action when no (...) factor contributing to that action is up to that agent. Against Derk Pereboom and Clarke, I argue that the versions of agent-causal libertarianism they claim can immunize the agent to the Basic Argument actually fail to do so. Against Robert Kane, I argue that the Basic Argument does not rely on the premise that simply the presence of indeterministic factors in the process of bringing an action about is itself what rules out the agent's chance for being responsible for that action. According to Scheck, Newfeld, and Dwyer (2000), there have been innumerable individuals wrongly convicted of a crime and sentenced to life imprisonment or to death based upon faulty evidence. The historical development of DNA evidence as a tool in the investigative process during the past 25 years is explained/analyzed, and the role of eyewitness evidence in the wrongful conviction of innocent individuals. This paper culminates in the Anthony Capozzi case study where eyewitness testimony wrongfully imprisoned a man before the advent (...) of DNA technology and which ultimately freed him years after the crime. The methodology used is the examination of journal articles, books, and newspaper articles on the phenomenon of wrongful convictions. (shrink)
